Patient Service Agreement
This Patient Service Agreement (“Agreement”) is entered into by and between Phleb-Finders, LLC (“Phleb-Finders,” “Company,” “we,” or “us”) and the undersigned individual receiving services (“Patient,” “you,” or “your”). This Agreement is effective as of the date of acceptance (“Effective Date”).
1. Services Provided
Phleb-Finders facilitates and coordinates mobile specimen collection services. Pursuant to this Agreement, Phleb-Finders will arrange for a qualified, properly credentialed phlebotomist to perform a one-time blood specimen collection at the Patient’s designated location.
Phleb-Finders does not perform laboratory testing and is not a laboratory. All testing is performed by a third-party laboratory selected by the Patient or the ordering provider.
2. Fees and Payment
A. Standard Scheduling (Three (3) or More Business Days’ Notice)
The fee for a scheduled blood draw with at least three (3) business days’ notice is $85 per person, plus 30 miles round trip.
B. Expedited Scheduling (Less Than Three (3) Business Days’ Notice)
If the blood draw is scheduled to occur within three (3) business days of the request, the fee is $115 per person, plus 30 miles round trip.
C. Mileage
Mileage for the contracted phlebotomist will be calculated and disclosed in advance. Mileage must be approved by the Patient prior to confirmation of the appointment.
If more than one patient is serviced at the same location and time, mileage will be billed only once.
D. State-Specific Fee Adjustment
An additional $30 service fee per draw applies to appointments performed in California and New York due to increased operating costs and regulatory requirements.
E. Nevada
Phleb-Finders does not currently provide services in the State of Nevada.
F. Payment Terms
Full payment is required prior to the scheduled appointment. Services will not be performed without confirmed payment.
All payments are non-refundable except as expressly provided in the Cancellation section below.
3. Cancellations and Refund Policy
Appointments may be cancelled without penalty if notice is provided at least 2 (two) business days prior to the scheduled appointment time.
If cancellation occurs within 2 (two) business days of the scheduled appointment, the service fee is non-refundable.
If a phlebotomist arrives and the draw cannot be performed due to Patient unavailability, lack of required materials, or failure to meet preparation requirements, the service fee is non-refundable.
4. Specimen Handling and Limitations
Phleb-Finders ensures that specimens are collected and handled in accordance with applicable professional standards and transported as directed by the Patient or ordering provider.
Phleb-Finders is not responsible for:
Laboratory processing errors
Lost or delayed shipments once transferred to a carrier
Rejected specimens due to improper kits, incorrect documentation, or laboratory requirements outside of Phleb-Finders’ control
Any concerns regarding the collection process must be reported to Phleb-Finders within five (5) calendar days of the appointment.
5. Patient Responsibilities
The Patient agrees to:
Have the complete and correct blood draw kit available at the time of the appointment.
Provide all required documentation, requisitions, and instructions prior to the phlebotomist’s arrival.
Follow all fasting, preparation, and timing requirements provided by the ordering provider or laboratory.
Ensure a safe and appropriate environment for specimen collection.
Failure to meet these requirements may result in inability to perform services without refund.
6. Independent Contractor Status
Phlebotomists arranged by Phleb-Finders are independent contractors and are not employees, agents, or partners of Phleb-Finders. Phleb-Finders coordinates scheduling and logistics but does not supervise medical judgment or laboratory procedures.
7. No Medical Advice
Phleb-Finders does not provide medical advice, diagnosis, or treatment. Patients should consult their licensed healthcare provider regarding test interpretation and medical decisions.
8. Confidentiality and Privacy
Phleb-Finders maintains appropriate safeguards to protect patient information in accordance with applicable federal and state privacy laws. Patient information is used solely for the purpose of coordinating and providing specimen collection services.
9. Limitation of Liability
To the fullest extent permitted by law, Phleb-Finders’ total liability for any claim arising out of or relating to this Agreement shall not exceed the amount paid by the Patient for the services rendered.
Phleb-Finders shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to services provided.
10. Indemnification
The Patient agrees to indemnify and hold harmless Phleb-Finders from any claims, damages, or expenses arising from:
Incorrect or incomplete laboratory kits or instructions
Failure to follow preparation instructions
Misrepresentation of medical information
Unsafe conditions at the service location
11. Dispute Resolution
Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration administered by the American Arbitration Association under its applicable rules.
Arbitration shall take place in Maricopa County, Arizona. Each party shall bear its own attorneys’ fees unless otherwise required by law.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.
13. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior understandings, whether written or oral.
